Service Agreement
Welcome to KKON TECHNOLOGIES SME PLANS! You asked, and we delivered! Our plans are cost-effective, reliable, and fast. We offer 5 separate options to meet your small-scale business needs at pocket-friendly prices. By purchasing any of our SME PLANS, you agree to be bound by the following terms and conditions.
2. Definitions
“Internet Service” refers to the internet-enabled services available to you on the KKON Tech Network.
“Customer” refers to any individual or entity who pays for the internet service and uses the service.
“Customer Facilities” shall mean the facilities or utilities provided by the Customer for service delivery at the designated location.
“Force Majeure Event” refers to any cause beyond the reasonable control of either Party that prevents compliance with obligations under this Agreement.
“Minimum Service Term” is a period equal to half of the agreed Service Term for the Service as stated in the Service Order Form.
3. Services/Charges
3.1. KKONTech shall invoice the Customer for service fees, including installation and monthly subscription costs.
3.2. The Customer must pay the installation fee and first-month subscription fee before installation.
3.3. Installation will occur within 5-7 days after payment.
3.4. The Customer must provide stable power for the Modem to activate and use the internet service.
3.5. A safe workspace must be provided for the technician, and all cables must be properly connected to avoid electric shocks.
3.6. All payments include VAT as per legal requirements.
3.7. Payment should be made via bank transfer to the account specified on the invoice or through designated payment channels.
3.8. KKONTech is not liable for incorrect payments or payments to unauthorized accounts.
3.9. Service disruption entitles the Customer to a service extension equal to the duration of the disruption.
3.10. No monetary refunds/compensation for service disruption or data loss.
4. Customer Responsibility
4.1. Customers must use the Service in compliance with laws and regulations. Misuse may result in suspension or termination.
4.2. Customers are responsible for handling the modem with care; damages due to negligence may incur replacement charges.
5. Internet Protocol Address Allocation
5.1. Any IP address allocated by KKONTech remains its property, and the Customer may use it under a nonexclusive, non-transferable license.
5.2. Customers may purchase an exclusive IP address if desired.
6. Representations and Warranties
6.1. Each Party represents that it has the authority to execute and fulfill its obligations under this Agreement.
6.2. KKONTech guarantees the Service will be provided per applicable laws, with skill, diligence, and care.
7. Limitation of Liability
7.1. Neither Party shall be liable for indirect or consequential damages. KKONTech’s liability shall not exceed sums paid by the Customer in the past 12 months, excluding payment obligations.
8. Confidentiality
8.1. Confidential information shared between Parties must be held in strict confidence and treated as each Party’s confidential information.
8.2. Terms and details of this Agreement constitute Confidential Information and must be protected as such.
9. Intellectual Property
9.1. KKONTech retains rights to any software or Intellectual Property provided for service use. The Customer is granted a limited, non-transferable license for the duration of this Agreement.
10. Force Majeure
10.1. Neither Party shall be in default if delayed by a Force Majeure Event. If unresolved after a month, either Party may terminate this Agreement.
11. Acceptable Use
11.1. Customers must use the Service according to applicable laws and regulations.
12. Data Protection
12.1. Each Party must comply with privacy and data security laws, including the Nigeria Data Protection Regulation 2019.
13. Governing Law and Dispute Resolution
13.1. This Agreement shall be governed by Nigerian law, and disputes shall be settled by a competent Nigerian court.
14. Amendment
14.1. KKONTech reserves the right to amend these terms and conditions. Customers will be notified of changes via our communication channels.
15. General Commitment
15.1. Each Party agrees not to act in a way that defeats the expectations set forth in this Agreement.
16. Governing Law
16.1. The terms shall be governed by the laws of Nigeria.
16.2. Disputes shall first be settled amicably. If unresolved, they shall be referred to the Lagos Multi-Door Courthouse for mediation.
